Terms of Service
Welcome to Bluestand. These Terms of Service ("Terms") govern your use of the Bluestand mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is operated by [LEGAL ENTITY OR FOUNDER NAME] ("Bluestand," "we," "our," or "us"), based in Serbia.
1. What Bluestand is
Bluestand is a photography app where users contribute photos taken at specific GPS-aligned sightlines, building a long-term archive of places. Each photo is matched to a real-world "spot" with a defined viewing direction, so contributions from many people over time form a shared visual record of a location.
2. Eligibility
You may use Bluestand if you are at least 13 years old, or the minimum digital consent age in your country, whichever is higher. In several EU countries this minimum is 16. If you are under the minimum age, you must have permission from a parent or legal guardian.
3. Your account
When you create an account, you agree to:
- Provide a valid email address and a username that you can use.
- Keep your password confidential. You are responsible for all activity under your account.
- Not impersonate another person or misrepresent your affiliation.
- Not create accounts by automated means or for the purpose of evading suspension.
Your username must meet the format and length rules enforced by the Service. We may reclaim usernames that are inactive, that infringe on others' rights, or that are clearly intended to impersonate a person, brand, or entity.
4. Your content
You retain all rights to the photos, captions, and other content you upload to Bluestand ("Your Content").
By uploading Your Content, you grant Bluestand a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute Your Content for the sole purpose of operating, providing, and improving the Service. This license terminates when you delete the content or your account, except where retention is required for legal reasons or where the content has already been shared by others.
You represent and warrant that:
- You own Your Content or have all rights necessary to grant the license above.
- You have obtained consent from any identifiable people who appear in Your Content, where such consent is required by law.
- Your Content does not infringe any third party's intellectual property, privacy, publicity, or other rights.
We do not claim ownership of Your Content, and we do not use it for advertising or sell it to third parties.
5. Acceptable use
You agree not to upload, post, share, or transmit content that:
- Is illegal under applicable law.
- Sexually exploits, abuses, or endangers children. We have zero tolerance for child sexual abuse material (CSAM) and will report it to the appropriate authorities.
- Depicts or facilitates non-consensual intimate imagery, harassment, threats, or stalking.
- Promotes terrorism, violence, self-harm, or organized hate against a protected group.
- Contains malware or seeks to compromise the Service or other users' accounts.
- Infringes intellectual property, privacy, or publicity rights.
- Is fraudulent, deceptive, or constitutes spam.
You also agree not to:
- Scrape, mirror, or systematically download data from the Service except as permitted by API or feature.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law.
- Use the Service for commercial purposes without our prior written permission.
- Interfere with or disrupt the Service, including circumventing rate limits or security measures.
6. Reporting and moderation
You can report content or accounts that violate these Terms from within the app. We review reports and may, at our discretion, remove content, restrict features, or suspend or terminate accounts that violate these Terms, with or without notice.
You can also block another user. Blocked users are mutually hidden from each other inside the Service.
We are not obligated to monitor all content, but we may do so to enforce these Terms or comply with law.
7. Suspension and termination
You may delete your account at any time from within the Settings screen. When you do, we delete your personal data as described in our Privacy Policy.
We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if your account creates legal risk for us or other users, or if we discontinue the Service. We will give you reasonable notice where possible.
8. Intellectual property of the Service
The Service itself — the Bluestand name, logo, app design, and underlying software — belongs to Bluestand and is protected by intellectual property laws. Nothing in these Terms grants you any rights in the Service beyond the limited license to use it on your device.
9. Third-party services
The Service uses third-party providers (including Supabase, Mapbox, Sentry, Expo, Resend, Cloudflare, and Vercel) to function. Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for the actions, content, or terms of third parties.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that any defects will be corrected. We do not endorse and are not responsible for any user content.
Some jurisdictions do not allow the exclusion of certain warranties. In those cases, the exclusions above apply to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, Bluestand and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service.
Our total liability for any claim arising out of or related to the Service is limited to fifty euros (EUR 50) or the amount you paid us in the twelve months before the claim, whichever is greater.
These limitations do not apply where prohibited by law, including for damages caused by our intent or gross negligence, or in respect of EU consumers' statutory rights.
12. Indemnification
You agree to defend, indemnify, and hold harmless Bluestand and its operators from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your Content,
- Your use of the Service,
- Your violation of these Terms or applicable law, or
- Your violation of any third party's rights.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law principles.
If you are a consumer in the EU/EEA, you also benefit from any mandatory consumer-protection rights of the country in which you reside, and nothing in these Terms reduces those rights.
Any dispute arising out of or related to these Terms or the Service will be resolved by the competent courts of [CITY], Serbia, except where mandatory law requires otherwise.
EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you in the app or by email before the changes take effect. Continued use of the Service after the effective date of an update means you accept the updated Terms.
